Yes, we do have floods in Yellowstone County. Wherever there's a river, you can be sure there will be some flooding. The floodplain regulations shall apply to all lands within the jurisdiction of the County of Yellowstone, Montana.

FloodplainViolations

The Floodplain Administrator shall bring any violation of the Floodplain regulations to the attention of the Yellowstone County Commissioners, the Yellowstone County Attorney, and the Montana Department of Natural Resources and Conservation.

Any use, arrangement, or construction not in compliance with that authorized shall be deemed a violation of the regulations, and punishable as provided in Section 4.8 or enforced as provided in 76-5-109 MCA. An applicant may be required to submit certification by a registered professional engineer, architect, or other qualified person designated by the Floodplain Administrator, that finished fill, building floor elevations, flood proofing, hydraulic design, or other flood protection measures be accomplished in compliance with these regulations.

Violation of the provisions of the regulations or failure to comply with any of the requirements, including failure to obtain permit approval prior to development of flood prone lands and conditions and safeguards established, shall constitute a misdemeanor. Any person who violates these regulations or fails to comply with any of its requirements shall, upon conviction thereof, be fined not more than five hundred ($500) or imprisoned for not more than six (6) months or both. Each day such violation continues shall be considered a separate offense. Nothing herein contained shall prevent the County of Yellowstone from taking such other lawful action as is necessary to prevent or remedy any violation.
