Variance Application (.pdf)

The Board of Adjustment shall be composed of five (5) members residing within the Yellowstone County Zoning Jurisdictional area but outside the City of Billings and shall be appointed by the Yellowstone County Commissioners.

The Board of Adjustment shall have the following powers: (1) To hear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by an administrative official in the enforcement or interpretation of this chapter or of any resolution adopted pursuant thereto; (2) To authorize upon appeal in specific cases such variance from the terms of this chapter as will not be contrary to the public interest and where, owing to special conditions, a literal enforcement of the provisions of this chapter will result in unnecessary hardship, and so that the spirit of this chapter shall be observe and substantial justice done; and
(3) Exception to powers granted: The Board of Adjustment shall not hear application for variance from the requirements for minimum lot sizes contained in the tables of sections 27-303 and 27-304.

The Board of Adjustment shall have the authority to grant a variance from the terms of this chapter in specific cases where it is found that the granting of the variance will not be contrary to the public interest and where, because of special conditions with respect to the lot shape or topography, a literal enforcement of the provisions of the chapter would result in un- necessary hardship. Meets 2nd Thursday of every month, 4:00pm, 2825 3rd Avenue North, 4th Floor (Miller Building).
