9:00 a.m. PUBLIC HEARING – Resolution 26-98 to Create RSID 923M – Bar 11 Subdivision – Parks. Ms. Monica Plecker, Public Works Director stated that she has a presentation for you this morning regarding the creation of RSID 923. I know a lot of the information that I'm going to share, you're probably familiar with, but we have had neighborhood interests, so I think there's a few things that I think it's just appropriate to go over. So sorry if it's not as brief as they usually are. So, this morning, we will just quickly go over some just RSID 101, cover why we're going to create it or why we're seeking to create it, the proposed assessment opposition that we've received, and then of course, any questions. So RSID stands for Rural Special Improvement Districts. Whenever a new subdivision is created, there are three districts that are typically created. There's one that's created for road. maintenance when those roads are public. There's one that's created for dry hydrants for the maintenance and replacement of those. And then also when there's public parks, there is one created for those as well. For this particular one, what the purpose of these RSIDs is to create a fund to do maintenance for those public improvements. It is for a dedicated area, an RSID that is for, say, the Bar 11 Subdivision would not be able to use those funds for any other subdivision. They are limited to that geographical area. The annual assessment is listed on the tax bill. Folks can go to their tax bill and see, usually it says RSID with a number, and then you can see your assessment there, and it's titled for what it is for. And then of course, also with RSIDs, assessments can change based on needs. On an annual basis, we go through, and we evaluate the accounts. We determine if the money is accruing at a level that's keeping up with the maintenance request. We also try to keep a base fund as well. And then we also have and do lower assessments when a fund has reached a manner that it doesn't make sense to keep accruing funds.
Ms. Monica Plecker, Public Works Director stated that for this particular subdivision, there is a subdivision improvement agreement that requires the creation of this district. As you can see, the area that I've circled there, it says that a maintenance district will be created with the approval of the final plat. This subdivision has already received final plat. I can't explain why it wasn't created with final plat, but it wasn't. It is public parkland that is owned by Yellowstone County. And we do need to have an RSID associated with it. The parkland that would be covered by this proposed RSID is a mixture of open and natural space and an area that would be maintained. The maintained area would be the northeast corner. You can see the entrance into the subdivision. There's parkland on both sides of the street there. Then the large acreage that is more of a natural and an open space that would be maintained more so for weed control and noxious weeds. The proposed assessment is $70 per year per lot, so that would be $35 at each half. All properties are assessed, not just properties that are already developed with homes. There are a number of vacant lots in the development. The proposed fee structure for the first year is intended to accomplish 2 things. One, to create a base fund, and two, to generate funds to cover new maintenance that will begin in the next season. If the Board of County Commissioners felt that the fee was too high or wanted to slow down, creating that base fee, you could certainly reduce from $70 per year. I do think that once we create the district and there is a fund established, there's no reason to keep it at $70. I would fully intend that next year we would reduce that rate because we would then have an established fee. Anytime you create an RSID, there is an opportunity for folks to protest in writing. We did receive 4 written letters of opposition, which you were provided. Those are listed here. With that being said, when the board considers whether it wants to pass or deny creation of a district, there's a threshold, basically a 51% that would have to be met. However, there is a waiver of right to protest, which was also submitted and filed with the final plat. That basically for a period of 20 years, waves the right to protest a rural special improvement district. So, if we were to exceed that 51% threshold, technically you could rely on the waiver if you wanted to. I'd be happy to answer any questions you might have. Commissioner Morse asked how many properties do we have in this subdivision? Ms. Plecker answered that 160 lots would be assessed. So, the first year based on the $70 per lot would be $11,500. So, we would estimate that basically, you know, we would utilize half of that to create the base fund. Then we would utilize those remaining funds then for next year's maintenance. Commissioner Morse stated that $5,500 would stay in the fund, you think, and then 5,500 for maintenance for next year. Ms. Plecker stated correct. Commissioner Morse asked Commissioner Waters and White if they had any question. Commissioner Morse opened the public hearing for resolution 26-98 to create RSID 923M. Two people spoke in opposition of the proposed RSID. Hearing no other comments Commissioner Morse closed the Public Hearing. Commissioner Waters made a MOTION to approve Resolution 26-98 to Create RSID 923M – Bar 11 Subdivision – Parks, Commissioner White seconded. Passed Unanimous.
PUBLIC COMMENTS ON REGULAR, CONSENT AND FILED AGENDA ITEMS – Hearing no comments Commissioner Morse continued the Board Meeting.

PUBLIC COMMENTS ON COUNTY BUSINESS – Sixteen citizens gave comments regarding the proposed Data Center in Broadview. Interim Sheriff O’Donnell commented on the incident that happened at MontanaFair. Hearing no other comments Commissioner Morse adjourned the meeting at 9:55 a.m.
