REGULAR MEETING OF THE BOARD OF COUNTY COMMISSIONERS

            ALL PRESENT:  Commissioner Morse, Chair; Commissioners Waters and White; Board Clerk Teri Reitz; Clerk and Recorder Jeff Martin.

            PLEDE:  MOMENT OF SILENCE, Held.

            MINUTES – October 7, 2025, and October 14, 2025.  Commissioner Waters made a MOTION to approve the Minutes, Commissioner White seconded.  Passed Unanimous. 

            9:00 a.m. BID OPENING – Bid Opening for MetraPark Upper Lot Crack Sealing.

Commissioner Waters made a MOTION to refer the bids to staff for recommendation back to this board, Commissioner White seconded.  Passed Unanimous.

            PUBLIC COMMENTS ON REGULAR, CONSENT AND FILED AGENDA ITEMS – One citizen spoke regarding the variance appeal on the Regular Agenda. 

            FINANCE – RSID Final FY25 Budget Adjustment.  Ms. Jennifer Jones, Finance Director stated that this is just a housekeeping issue.  Commissioner Waters made a MOTION to approve RSID Final FY25 Budget Adjustment, Commissioner White seconded.  Passed Unanimous. 

            PUBLIC WORKS – Variance Appeal – Approach – 5337 Abbey Road.  Ms. Monica Plecker, Public Works Director stated that Mackenzie Sparks has requested a variance to exceed the allowable approach width from the County's Road Policy. The applicant received a permit granting the authority for a 30' approach. County staff was in the vicinity when the site was being prepped. Ronni Tallerico a PW staff member stopped at the site and informed one of the workers on site the driveway should not be poured. She asked who the builder was and asked the worker to call Sam Sparks and inform him. Within 24 hours the approach was poured at a width of 55 feet. Upon review of the request, staff has denied the variance request. As such, the determination is being appealed, and the Board of County Commissioners shall determine whether it will approve or deny the variance request. The applicant's request is attached to this staff report and provides their proposed justification for the variance.

Justification for staff denial:

  1. The property does not present any unusual or unique physical features that require a driveway approach to be nearly twice the allowable width. 30' is a statewide standard that allows for sufficient access.
  2. To be consistent with adopted standards, the driveway approaches should be uniform. Maintaining, order, property distancing and managing stormwater.
  3. While it is recognized that non-compliant driveways exist throughout the county, many were constructed without permits or without the County’s knowledge. The presence of past violations is not justification for approving new ones.
  4. Oversized approaches create wider conflict points between vehicles and pedestrians along subdivision roads.

The Board of County Commissioners may approve or deny the appeal.  Commissioner Waters asked if the sub-contractor that was talked to by Ms. Tallerico was a new one or had they done this type of work before.  Ms. Plecker stated that to her understanding this person was a sub-contractor that was on site not a concrete worker.  Commissioner Morse stated he wanted to make sure he understands the process.  Commissioner Morse stated Ms. Sparks applied for the permit and Public Works went out and flagged and measured the approach and it was what was required by the permit.  Ms. Plecker stated that she wanted to ask Ms. Tallerico to confirm because she was the one who did the work.  Ms. Tallerico stated that she went out and took a picture of the two stakes and measured it and it was 30’.  Ms. Tallerico stated she went back by the home the Thursday before for the concrete was going to get poured and noticed there were concrete forms up and they were well above the 30’.  Ms. Tallerico stated that she stopped and one of the contractors came up to talk to her.  Ms. Tallerico asked the contractor who the builder was.  The contractor stated that the builder is Sam Sparks, and she asked him to tell him not to pour the concrete because it is well past the allowable 30’.  Commissioner Waters made a MOTION to deny the variance appeal for 5337 Abbey Road, Commissioner White seconded.  Passed Unanimous.
