          ALL PRESENT:  Commissioner Morse, Chair; Commissioner Waters; Board Clerk Teri Reitz; Clerk and Recorder Jeff Martin.

          PLEDGE:  MOMENT OF SILENCE, Held.

          MINUTES – July 15, 2025.  Commissioner Waters made a MOTION to approve the Minutes, Commissioner Morse seconded.  Passed Unanimous.

          9:00 a.m. PRESENTATION – Resolution 25-87 Renaming the Yellowstone County Administrative Building in Honor of John Ostlund.  Commissioner Waters read the resolution into the record.  Commissioner Waters made a MOTION to approve Resolution 25-87, Commissioner Morse seconded.  Passed Unanimous.  Ms. Kristie Ostlund stated that she really appreciates this.  John loved Yellowstone County, and he deserves it.  Bless your hearts. 

          9:00 a.m. RECOGNITION – Heather Webster – County Attorney – 10 Years of Service.

          9:00 a.m. ZONE CHANGE PUBLIC HEARINGS – A.)  County Zone Change 728 – 4449 and 4511 Central Ave – A to N4 – A zone change request from Agricultural (A) to Large Lot Suburban Neighborhood Residential (N4) on two proposed 1-acre parcels of land to be known as Lots 1 and 2 of Barber Farm Subdivision, in Tract 1A of C/S 2007 amended, a 57.064-acre parcel of land.  A pre-application neighborhood meeting was held on April 24, 2025, at the Emmanuel Baptist Church at 328 S Shiloh Road.  Tax ID: D00349.  Ms. Tate Johnson, Planner went through the staff report.  Ms. Johnson noted that the Yellowstone County Zoning Commission held a public hearing on July 14, 2025, and concurred with the recommendation for approval of the proposed zone change based on the 11 criteria for zone changes.  No public testimony was received.  The Commissioner found that the zoning proposed is compatible with adjacent zone districts and development in the area.  Commissioner Morse opened the Public Hearing.  One person spoke in favor of the proposed zone change.  Hearing no other comments Commissioner Morse closed the Public Hearing.  Commissioner Waters made a MOTION to approve Zone Change 728 with the 11 criteria, Commissioner Morse seconded.  Passed Unanimous.  B.)  County Zone Change 729 – 2602 Rockwood St. – RR-3 to N2 – A zone change request from Rural Residential 3 (RR-3) to Mid-Century Neighborhood Residential (n2) on Certificate of Survey 540, S30, T1N, R27E, a 9.48-acre parcel of land.  A pre-application neighborhood meeting was held on May 21, 2025, at the subject property, 2602 Rockwood Street (Tax Code: D06596).  Ms. Tate Johnson, Planner went through the staff report.  Ms. Johnson noted that the Zoning Commission is forwarding a recommendation of approval for the zone change.  Commissioner Morse opened the Public Hearing.  One person spoke in favor of the proposed zone change.  Eight people spoke in opposition of the proposed zone change.  Hearing no other comments Commissioner Morse closed the Public Hearing.  Commissioner Waters made a MOTION to approve Zone Change 729, Commissioner Morse seconded.  Passed Unanimous. 

          PUBLIC COMMENTS ON REGULAR, CONSENT AND FILED AGENDA ITEMS – Hearing no comments Commissioner Morse continued the Board Meeting.

          PLANNING DEPARTMENT – A.)  Maplewood Estates Subdivision – Preliminary County Major Plat.  Ms. Anna Vickers, Planning Division Manger went through the staff report.  Ms. Vickers stated that this subdivision would create 78 lots for residential development.  The subject property is generally located south of O’Donnell Land and east of South 72nd Street West.  Ms. Vickers went through the proposed conditions.  Ms. Vickers also noted that the applicant has requested a variance request.  Commissioner Waters made a MOTION to conditionally approve Maplewood Estates Subdivision – Preliminary County Major Plat with the SIA, Findings of Fact and the Variance request, Commissioner Morse seconded.  Passed Unanimous.  B.)  Banlee Subdivision, Preliminary Minor Subdivision. Ms. Anna Vickers, Planning Division Manager went through the staff report.  Ms. Vickers stated that the subject property is generally located on the north side of Highway 312 and east of Stanhope Road.  Ms. Vickers went through the proposed conditions.  Commissioner Waters made a MOTION to conditionally approve Banlee Subdivision, Preliminary Minor Subdivision with the SIA and the Findings of Fact, Commissioner Morse seconded.  Passed Unanimous.   C.)  Peterson Road Estates Subdivision – Preliminary Minor Plat.  Ms. Anna Vickers, Planning Division Manager went through the staff report.  Ms. Vickers stated that the subject property is generally located on the south side of Peterson Road and west of Montana State Highway 87.  Ms. Vickers went through the proposed conditions.  Commissioner Waters made a MOTION to conditionally approve Peterson Road Estates Subdivision, Preliminary Minor Plat with the SIA and Findings of Fact, Commissioner Morse seconded.  Passed Unanimous.

          CLAIMS – Batches 25-179, 25-179, 25-180, 26-005 and 26-006.  Commissioner Waters made a MOTION to approve the Claims, Commissioner Morse seconded.  Passed Unanimous.
