REGULAR MEETING OF THE BOARD OF COUNTY COMMISSIONERS

Tuesday June 7, 2022

          PRESENT:  Commissioner Pitman, Chair Pro-Tem, Commissioner Ostlund; Board Clerk Teri Reitz; Clerk and Recorder Jeff Martin.

          PLEDGE.

          MINUTES – May 10, 2022.  Commissioner Ostlund made a MOTION to approve the Minutes, Commissioner Pitman seconded.  Passed Unanimous. 

          9:30 a.m. PRESENTATION – Donald W. Jones – DNRC Basic Wildland Firefighter Course Completion.

          9:30 a.m. BID OPENING – Bid Opening for Asphaltic Mix for 2022 – 2023 for the Public Works Department.  No bids were received.  Mr. Tim Miller, Public Works Director gave the Commissioner’s a letter stating that Yellowstone County had decided to withdraw it’s Invitation for Bid for Asphaltic Mix for 2022 – 2023.  The reason for this decision is the volatility of oil prices making it difficult for suppliers to provide reasonable pricing for the coming fiscal year.  

          PULBIC COMMENTS ON REGULAR, CONSENT AND FILED AGENDA ITEMS – Hearing no comments Commissioner Pitman continued the Board Meeting.

          COMMISSIONERS – Proclamation 22-31 – World Elder Abuse Awareness Day.  Commissioner Ostlund read the proclamation into the record.  Commissioner Ostlund made a MOTION to approve Proclamation 22-31, Commissioner Pitman seconded.  Passed Unanimous. 

          FINANCE – A.)  Notice of Public Hearing for the Preliminary Budget for Fiscal Year 2022 – 2023 – Public Hearing Set for Tuesday June 21, 2022 @ 1:30 p.m. and continue through 5:00 p.m. Friday June 24, 2022, in the Commissioners’ Board Room 3108, Third Floor of the Stillwater Building.  Commissioner Ostlund made a MOTION to approve the Notice of Public Hearing, Commissioner Pitman seconded.  Passed Unanimous.  B.)  Resolution 22-30 Amending Resolution 90-02 Investment Fee on Pooled Investments for FY23.  Commissioner Ostlund made a MOTION to approve Resolution 22-30, Commissioner Pitman seconded.  Passed Unanimous. 

          HUMAN RESOURCES – Update on MFPE Negotiations.  Mr. Dwight Vigness, Human Resources Director stated that the Yellowstone County negotiation team has met with Montana Federation of Public Employees – Courthouse Unit on March 30th, April 6th, May 3rd, and May 17th.  The Yellowstone County negotiation team emailed the Union a proposal on May 20th, 2022.  Yellowstone County has not heard back from the Union until today.  The Union has respectfully declined the proposal and have forwarded Yellowstone County a counter proposal.  Mr. Vigness noted that Yellowstone County has not had a chance to sit down and look at the counter proposal.  No action is required on this item, this was just an update. 

          CLAIMS – Batches 22-182, 22-183, 22-184 and 22-185.  Commissioner Ostlund made a MOTION to approve the Claims, Commissioner Pitman seconded.  Passed Unanimous. 

          CONSENT AGENDA – 1.  COMMISSIONERS – A.)  Yellowstone County Fire Council Calendar Fundraising Project.  B.)  Board Reappointment – Jeff Keller to Custer Cemetery Board; Marcie Cooke Limpp to Yellowstone County Museum Board.  C.)  Board Appointment – Zachary Hassler to Lockwood Pedestrian Safety District Advisory Board.  D.)  Board Openings – Update List.  2.  FINANCE – A.)  Rejection of Terrorism Coverage for Dirt Events at Metra in FY23.  B.)  Resolution to Cancel Old Checks 8 Years and Older.  C.)  Extend Agreement with HRDC for General Fund Support.  D.)  Greeno Hill Communications Tower Site Lease with Exxon Mobil Pipeline Co.  3.  PUBLIC WORKS – Contract for Consultant Services for County Impact Fees Associated with Development with Tischler and Bise, Inc.  4.  SHERIFF – YCDF/CML Security Agreement Renewal for Period 7/1/22 – 6/30/23.  5.  TREASURER – 2022 Abatement List.  6.  HUMAN RESOURCES – A.)  FY23 American Fidelity Assurance Application.  B.)  PERSONNEL ACTION REPORTS – Detention Facility – 2 Terminations; Sheriff’s Office – 1 Salary & Other.

          FILE ITEMS1.  COMMISSIONERS – Public Comment – SZD Story Road.  2.  FACILITIES – Application to Use Courthouse Lawn.  3.  FINANCE – A.)  Budget Transfer – General Fund Services - $1600.  B.)  Justice Court is asking to move $2500 from their Witness/Jury Fees account to their Travel account to cover COLJ clerk training.  Commissioner Ostlund made a MOTION to approve the Consent Agenda and place the File Items to file, Commissioner Pitman seconded.  Passed Unanimous. 

          PUBLIC COMMENTS ON COUNTY BUSINESS – Two citizens spoke regarding DOC released inmates and sober living homes in Billings, Montana.  Hearing no other comments Commissioner Pitman adjourned the meeting at 9:45a.m.
